ATF Ends Form 4 Requirement for Suppressors, SBRs & SBSs
On October 9, 2026, the ATF issued formal guidance implementing the federal court ruling in Silencer Shop Foundation v. ATF. Effective immediately:
- No ATF approval required before making or transferring short-barreled rifles (SBRs), short-barreled shotguns (SBSs), suppressors/silencers, or "any other weapons" (AOWs)
- No Form 4 — transfers go through a standard Form 4473 background check, same as any firearm
- No registration in the National Firearms Registration and Transfer Record
- Applies to everyone — not just the parties in the lawsuit
Important: state and local laws are not affected by this guidance. Some states still impose their own requirements.
Background: on August 5, 2026, a federal judge ruled that reducing the NFA transfer tax to $0 (via the 2025 One Big Beautiful Bill Act) rendered the NFA's registration and approval requirements unconstitutional for these items. The DOJ has confirmed it will not appeal, making the change permanent.
